Response of the applicant in the Binbay case to the observations of the Turkish Government. The reply notes that the six-month rule for making the application did not date from the events of 21 March 1992 but from the lift-shaft attack on Binbay on 11 February 1994, and that the events prior to that date are all part of the pattern of harassment against Birbay. The reply maintains that domestic remedies in southeast Turkey are ineffective, and at no point following any attacks on Birbay has he received redress despite numerous complaints made on his part. The applicant also points out that the attack on his shop did not occur under the general unrest which occurred during the day but happened late at night when Van was under a police curfew, indicating that the premises were deliberately targeted. Appendices (in Turkish with English translations) include a statement from the applicant made on 3 April 1997 to the Diyarbakır State Security Court, a reply of the Directorate of Public Works and Housing of 23 September 1992 stating that Birbay's request for compensation for damages to his premises cannot be acted upon, and Birbay's subsequent petition to the Van Administrative Court.
