Letter from Kevin Boyle and Françoise Hampson to H.C. Krüger, Secretary to the European Commission of Human Rights, informing that they have been instructed to submit an application to the European Commission of Human Rights on behalf of Yasin Ateş to pursue a case against Turkey regarding the death of his son, Kadri Ateş, at the hands of police officers. Boyle and Hampson note that they are in the process of assembling documentation for the full application which will be submitted in January 1996, and asks for this current communication as notice of the applicant’s complaints for the purposes of the six-month rule. The letter also provides a summary of the facts of the case as submitted by the applicant. Attached to the letter are three appendices (in Turkish with English translations):
A) Yasin Ateş's letter of 19 July 1995 authorising Boyle and Hampson to be his legal representatives;
B) Statements of Yasin Ateş (19 July 1995) and Kadri Ateş’s father-in-law Vebhi Demir (25 July 1995). Demir was travelling with, and arrested and tortured alongside, Kadri Ateş. Demir was detained for 16 days. On the 15th day of custody, Demir was taken for interrogation and again subjected to beatings, during which he continued to deny all accusations. His interrogators then stated, “You're very lucky. Haven't you heard? We have killed Kadri. He kicked the bucket. If they hadn't killed him, we'd have murdered you”. Thereafter they informed him, “Your time is up... You have two choices. Either you will go to join Kadri, or we'll send you to prison and you'll kill ten people with the poison we will give you”. They further added, “Look, there are teams here. If we surrender you to them, they will kill you like Kadri”.’
C) Official report of the incident submitted by the Gendarmes involved, which claims that Kadri Ateş was killed by crossfire while attempting escape from a clash at the roadblock near Lice (14 June 1995).
