Observations of the Turkish Government on the applicant's claims for just satisfaction in the Nejdet Buldan case. The Government rejects the claims and states that no violation of the European Convention on Human Rights has occurred. The Government accuses Buldan of having been in a relationship with the PKK until 1999 and claims that his flee to Germany is likely a result of his being a target of the PKK for having 'damaged the struggle' rather than the threats he received after his brother's death. As such, the Government requests that any of Buldan's claims regarding his flee to Germany not be considered. The Government also claims that Buldan cannot substantiate his business or property holdings in Turkey, and that the fees claimed for his sister-in-law and her children, as well as the legal fees claimed, are excessive. Attached is a translation of a statement made Nejdet Buldan by on 8 September 2002 rejecting the idea that he or his nephew received sponsorship from Germany in order to help dissolve the PKK, which the Government appended to show as an example of the deteriorated relationship.
