Memorials of the Turkish Government and of the applicant submitted to the European Court of Human Rights in the Yaşa case.
1) Memorial of the Turkish Government submitted 2 March 1998 (published 30 March 1998, includes 2 English copies and 1 French copy) in which the Government contends that Eşref Yaşa has no standing to present an application on behalf of his uncle as he is not direct next-of-kin, that the applicant has not availed himself of domestic remedies, and that ethnic discrimination is illegal in Turkey and that Yaşa’s allegations ‘should be explained by the ulterior motive to bring political pressure to bear on Turkey. 2) Memorial of the applicant in the Eşref Yaşa case, including his claims for just satisfaction, submitted 3 March 1998.. The applicant asks the Court to admit the Susurluk Report (A44/43/2/9) as material evidence, to confirm the Commission’s opinion with respect to the State’s failure to protect the right to life under Article 2 of the European Convention on Human Rights, and to confirm other various violations of the Convention. The memorial contains 6 appendices regarding the Susurluk incident/Susurluk Report and the intimidation of journalists in Turkey. (c. 140pp)
