Memorial (in French) of the Turkish Government in the Çakıcı case. The Government reiterates its request to dismiss the case as it claims that domestic remedies have not been exhausted by the applicants, that the conclusions of European Convention on Human Rights violations reached by the Commission are based on the testimony of a single witness (Mustafa Engin) who the Government claims later refuted his testimony before the police and the public prosecutor, and that 'contradictory testimony' was not analysed or taken into consideration. Attached as Annex 1 to the memorial are the previous observations (in French) of the Turkish Government regarding the Çakıcı case. Attached as Annex 2 are English translations of various domestic court decisions and appeals in Turkey which the Government provides as evidence that restitution via domestic remedies is possible in Turkey. Françoise Hampson's annotations are present throughout the memorial. Attached are 6pp of Hampson's handwritten notes on foolscap regarding the various legal decisions documented in Annex 2.
