Case summary of Cafer Erdoğan v. Ministry of Interior and others, in which the plaintiff appealed to the Court of Appeal, 4th Civil Division after having his case dismissed in the Court of First Instance. Erdoğan claimed that he was arrested on suspicion of murder and was tortured in the police station, and thus sought 4 million lira for material damages and 2 million lira for moral damages. The Court of First Instance had rejected the claim as it could not be proved who tortured Erdoğan, and even if it was proved who did, the Administration could be held liable for the actions of a public servant. The Court of Appeal quashed the lower court's decision and ruled in favour of the plaintiff with regards to his compensation claim against the Administration and two identified police officers.
