Internal letter from Françoise Hampson to the Kurdish Litigation Project team regarding the implications of the 12 March 1998 opinion issued by the European Commission of Human Rights in the Çakıcı case and its 15 April 1998 opinion issued in the Selma Tanrıkulu case (A44/43/1/52). Hampson notes that the findings are potentially significant for other cases being litigated by the Project. Hampson notes that: the Commission have found that police custody records in multiple Turkish locations and jurisdictions pertinent to Project cases are unreliable; the Commission cannot find any document indicating that the body found at Kıllıboğan Hill was that of Ahmet Çakıcı; the Commission believes strongly that Ahmet Çakıcı is dead, meaning that the Turkish Government has failed to comply with the obligation under Article of the Convention that everyone's right to life shall be protected by law; and the Commission states it is enough for prosecutors to verify their own records for the places of detention under their jurisdiction.
