1) Further observations of the Turkish Government on the Tekin application, submitted 18 May 1995 to the European Commission of Human Rights. The Government states that 'the application is a clear sign of political propaganda directed to discredit the security forces fighting with terrorism' and maintains that domestic remedies have not been exhausted (6pp) (CLOSED UNTIL 2073/11/01)
2) Reply of the applicant to the Government's further observations. The reply notes that the Derik public prosecutor commenced prosecution against Salih Tekin after Tekin had already been released from custody due to insufficient evidence of the charges against him and acquitted, and after Tekin was again arrested on 23 January 1994. The applicant requests the Government to submit records of this arrest. The reply also notes that the public prosecutor's investigation into Tekin's complaint filed against the gendarmes he accused of torturing him did not begin for at least 10 months following the complaint. 3) Letter (in Turkish) from the Diyarbakır Branch of the Human Rights Association stating that Salih Tekin had been taken into custody. This was soon revealed to be an unrelated person with the same name as the applicant. (9 October 1995, 1p)
