Final pleadings of the applicant (submitted 24 November 1998) and the Turkish Government (submitted 25 January 1999) on the merits of the Beşir Taş application to the European Commission of Human Rights, as well as the Commission’s report on the case (adopted 9 September 1999). The applicant submits that the Government's explanation for ‘losing’ his son is ‘not merely implausible but unbelievable. The Government is therefore accountable for the fate of his son, who entered custody on 14 October 1993 and has never left it.’ The Government maintains its prior opinions and observations on the application. The Commission’s report finds unanimously that violations of Articles 3, 5, and 13 of the European Convention on Human Rights occurred, and by 27 votes to 1 that a violation of Article 2 occurred (the Commission’s report is available for viewing at https://hudoc.echr.coe.int/eng?i=001-46202).
