The report notes that 'The decision of the Court implies that it itself has taken no position on the facts of the case brought before it... ...I do not believe that this is fair to the applicants or witnesses who testifies before the Commission. To lump all deliberate, intentional killings as "the occurrence of individual cases of death resulting from the use of unjustified force" is an affront to the facts in most of these cases.... ...it is clearly the trend of the Court to follow the precedent set in Akman v . Turkey where it unilaterally accepted the Government's declaration as a settlement of the case, in the face of the applicant's refusal to accept a friendly settlement... ...we have to acknowledge the tendency of the Court to prefer to strike these out.'
