Materials pertaining to the case filed by Mustafa Koku on 19 April 1995 against the Republic of Turkey with the European Commission of Human Rights (application number 27306/95, referred to internally within the Kurdish Litigation Project as Case 167 and assigned to Tony Fisher as lead) regarding the death of his brother Hüseyin Koku, who was allegedly detained by the police on 20 October 1994 and whose body was found in a location outside the town of Pötürge on 26 April 1995. On 31 May 2005, the European Court of Human Rights ruled that violations of Articles 2, 13, and 38 of the European Convention on Human Rights had occurred in this case. The Turkish Government were ordered to pay Hüseyin Koku’s widow and children €60,000 in pecuniary damages and €20,000 in non-pecuniary damages, and to pay Mustafa Koku €3,500 in non-pecuniary damages and €15,000 in legal costs and expenses.
