Legal documents relating to a case in the Court of the Exchequer, between William Butler and Richard Wilson and Reverend Joseph Wilson, concerning the lands of Castlecrine, Co. Clare. In 1686 Dominick Fanning, Cappanalaght, Co. Clare mortgaged the lands of Castlecrine and Cappanalaght to Richard Maguire, Limerick, for £100 plus interest, and subject to a clause for redemption. John Jephson, grandson of Richard Maguire assigned this mortgage to Richard Wilson senior, Moygallow, Co. Clare, in 1707. Soon after Dominick Fanning made further borrowings from Richard Wilson, secured by a mortgage of the lands of Castlecrine, his total borrowings were £176.5.0. Dominick Fanning then conveyed the equity of redemption to William Butler of Mossroe, Co. Clare, esq, who filed a bill of complaint against Richard Wilson senior and junior in the late 1710s. William Butler's second son, Thomas, the plaintiff's father, who was subject to intermittent fits of insanity, inherited the equity of redemption. In October 1724, Thomas Butler and Richard Wilson signed an account of the financial position between them, Richard Wilson allegedly imposing on Thomas Butler and charging him interest on interest due, while only crediting Thomas Butler with £15 for his own rent of the lands. In October 1733 Thomas Butler agreed to rent the lands of Castlecrine to Joseph Wilson, a brother of Richard Wilson junior, for £23, the rent to be paid to Richard Wilson in discharge of the mortgage. Richard Wilson took possession of the lands himself in 1738 and had surrendered most of them by 1746. William Butler took the matter to court as he wished to come to an agreement with Richard Wilson about the mortgage, with allowances made for the rents Richard Wilson was paid, and for damages Richard and Joseph Wilson allegedly caused to the property.
