Scope and content

Materials pertaining to the case introduced on 31 January 1995 and filed on 16 October 1995 by Kerem Soylu and his nephew Mehdi Soylu against the Republic of Turkey with the European Commission of Human Rights (referred to internally within the Kurdish Litigation Project as Cases 150 and 151 and assigned to Sheldon Leader as lead) regarding the 27 November 1993 destruction of their homes in Nurettin, Malazgirt District, Muş Province during a raid on the village by state security forces. The Soylus also alleged that the security forces attempted to force them to become village guards which they refused and as a result were forced to leave the region entirely and move to İstanbul. The Soylus reported continuing harassment during 1994 including the unauthorised harvesting of their crops by village guards. Kerim Soylu stated that he was wanted by state forces because he was elected to the People’s Labour Party (HEP) regional executive committee. The application appears to have not admitted by the Commission as it was not considered to be submitted within six months of the incident.
Materials in this file include: The notice of application of 31 January 1995 including statements of the Soylus and their family members as well as power-of-attorney authorisations; the application of 16 October 1995 including statements of the Soylus and their family members; copies of petitions made to Government agencies during 1994; the letter of response from the Commission (CLOSED UNTIL 2073/11/01); further statements of Kerem Soylu and Mehdi Soylu made during 1997 stating their losses, damages, and further harassment including confiscation of Kerim Soylu’s land and Mehdi Soylu’s arrest and torture; and a letter from Karen Hulme of the University of Essex dated 21 November 2000 attempting to answer the Court’s questions regarding the six-month rule and itemising further actions that had been taken against the Soylu family.
