Materials pertaining to the case filed on 4 May 1995 by İsak Tepe against the Republic of Turkey with the European Commission of Human Rights (application number 27244/95, referred to internally within the Kurdish Litigation Project as Case 176 and assigned to Nicholas Stewart as lead, later transferred to Philip Leach of the Kurdish Human Rights Project after Kevin Boyle and Françoise Hampson withdrew as representatives in the case on 16 February 2000) concerns the applicant’s allegations that his son, Mr Ferhat Tepe, was abducted and killed by undercover agents of the Turkish state in mid-1993 after being charged with aiding and abetting the PKK. On 9 May 2003,, the Court ruled unanimously that there had been a violation of Article 2 of the European Convention on Human Rights on account of the national authorities’ failure to carry out an adequate and effective investigation into the circumstances surrounding the death of the applicant’s son. Tepe was awarded €14,500 in pecuniary and non-pecuniary damages and €14,500 in legal costs and expenses (less €2,922.97 received in legal aid).
