Early draft of the applicant's response to the Turkish Government's observations concerning just satisfaction in the Buldan case (A44/43/1/19/2/19).
Applicant's response to the Turkish Government's observations concerning just satisfaction in the Buldan case, noting that nothing in the Government's newly-submitted evidence (A44/43/1/19/2/12) undermines the existing claim as nothing in the documents pertains to any events which took place before the applicant fled to Germany in 1994, and that the submissions of the evidence only serves to delay the case proceedings further. The response also notes that even if the PKK did threaten Buldan to the point where Buldan had to flee the country, the Government should have provided protection to the necessary degree to protect his life. Attached to the response are copies of previously submitted documents, annexes, and appendices which substantiate Buldan's claims for just satisfaction, including land title deeds, Buldan family business records, and Buldan's letter to Sheldon Leader of 18 September 2003.
Text of Françoise Hampson's speech made on behalf of the applicant at the 2 February 2000 oral hearing in the Nasır İlhan case held in the Human Rights Building, Strasbourg. She repeats the claims of the applicant submitted in the memorial and requests that any awarded judgment be paid in pounds sterling. (3 copies)
Statements of Salih Çetin and his lawyer Sedat Aslantaş that were submitted to the European Court of Human Rights along with Çetin's application, plus Çetin's letter authorising Kevin Boyle and Françoise Hampson to be his legal representatives.
Françoise Hampson's typed summaries of documents submitted on behalf of the application in the Dulaş case, plus the statements made to the Diyarbakır Branch of the Human Rights Association by Zübeyde Dulaş and son Avni Dulaş.
Abdurrahman Çelikbilek's statement of 8 September 1999 regarding his 1994 detainment and two witnesses he will try and persuade to testify.
Copies of articles published in Özgür Gündem between the beginning of 1993 and its closure in April 1994 regarding the PKK (Kurdistan Workers' Party).
Submissions made on behalf of the applicant pertaining to revelations in the Susurluk Report that the abduction and murder of Savaş Buldan was carried out by agents of the Turkish State.
Submission made on behalf of the applicants in the Ersöz and others (Özgür Gündem) case to the European Commission of Human Rights. The submission informs the Commission about the contents of the Susurluk report (A44/43/2/9) which exposed deliberate, state-sponsored campaigns against journalists, businessmen, and opposition leaders, particularly of Kurdish origin. The submission also informs that lead applicant Gurbetelli Ersöz died in autumn 1997 in northern Iraq (note: Ersöz, who was no longer allowed to practice as a journalist in Turkey, had joined the PKK in 1995 and was killed in combat).
Applicant's submissions on the merits of the Gündem application to the European Commission of Human Rights. The applicant 'points out that the procedure to investigate complaints against agents of the State is biased and not independent' and notes how decisions of non-jurisdiction in southeast Turkey by public prosecutors lead to district governors and administrative authorities being allowed to control investigations. Attached as appendices are statements of the applicants in the Mahmut Demir/Sıddık Yaşa case (A44/43/1/24), and two NGO reports on forced displacement, village destructions, and the implementation of the village guard system, in southeast Turkey.
