Materials pertaining to the application submitted by six Iraqi nationals, Mrs Halima Musa Issa, Mrs Beebin Ahmad Omer, Mrs Safia Shawan Ibrahim, Mrs Fatime Darwish Murty Khan, Mrs Fahima Salim Muran and Mrs Basna Rashid Omer (application number 31821/96, referred to internally within the Kurdish Litigation Project as Case 58 and assigned to Françoise Hampson as lead) on 2 October 1995 to the European Commission of Human Rights regarding the deaths of their husbands which they claimed occurred when the Turkish army crossed into Iraq in April 1995. On 23 June 2000, Hampson and Kevin Boyle stood down in favour of Philip Leach. On 18 July 2002, Leach stood down and by a letter of 16 August 2004 the applicants informed the Court that they had appointed Kerim Yıldız, Executive Director of the Kurdish Human Rights Project, as their representative. On 16 November 2004, the Court held that the applicants' relatives did not come within the jurisdiction of the respondent State within the meaning of Article 1 of the Convention and that it was therefore not necessary to examine the applicants' complaints under Articles 2, 3, 5, 8, 13, 14 and 18 of the Convention.
Materials include: the original application (including witness statements); the applicants’ reply to the Turkish Government’s observations (including transcripts of interviews with the applicants and other appendices); English translations of the interviews; Françoise Hampson’s working notes and schedule of legal fees; the 30 May 2000 decision of the European Court of Human Rights declaring the application admissible; and Hampson’s letter of withdrawal.
