Materials pertaining to the case filed by Erdal Karakoç on 11 April 1995 against the Republic of Turkey with the European Commission of Human Rights (application number 28294/95, referred to internally within the Kurdish Litigation Project as Case 212 and assigned to Kevin Boyle as lead, later succeeded by Philip Leach) regarding the October 1994 destruction of his home and property in Kozluca, Hozat District, Tunceli Province following the forcible evacuation of the village by Turkish security forces. Materials available for access include the application itself, along with associated appendices and witness statements, the applicant’s reply of 29 November 1996 to the observations of the Turkish Government, and the 23 June 2000 notice of withdrawal from the case signed by Françoise Hampson on behalf of herself and Kevin Boyle. NOTE: Correspondence from the Commission, as well as the observations of the Turkish Government, are closed to access until 1 November 2073.
On 16 November 1994, Karakoç lodged a petition with the Public Prosecutor's office in Hozat and requested that an investigation be initiated against those responsible for the evacuation of his village and the destruction of his property. On 26 January 1995, the Hozat District Governor wrote a letter in reply to the applicant stating that he could not be provided with housing as he did not fulfil the requirements of Law no. 2510 on housing. Karakoç did not pursue any other domestic remedy. The Government claimed that Karakoç left his village on account of the terrorist activities in the region and that there was no evidence indicating that his house was burned down. The Government also stated that the Hozat District Governor supplied the applicant with accommodation upon his request and that he further received aid for food, heating and rent; however, the applicant did not apply to the authorities to receive the monetary aid which was due at the time.
On 23 June 2000, Kevin Boyle and Françoise Hampson stood down as legal representatives in the case in favour of Philip Leach; leach later stood down in favour of Anke Stock of the Kurdish Human Rights Project. On 2 November 2004, a friendly settlement was reached in this case in which the Turkish Government agreed to pay Karakoç €48,000 ex gratia.
