Materials pertaining to the case filed on 27 April 1995 by Enver Uykur against the Republic of Turkey with the European Commission of Human Rights (application no. 27599/95, referred to internally within the Kurdish Litigation Project as Case 197 and assigned to Tim Otty as lead) regarding his 4 December 1994 detainment by security forces.
Uykur was the deputy district leader of the Osmaniye Branch of the Motherland Party (ANAP) and of the Democracy Party (DEP) before that. Both parties supported greater rights for the Kurdish minority in Turkey. On 4 December 1994, Uykur was taken into custody by members of the security forces, where he alleged that he was blindfolded, beaten, punches, had his testicles squeezed, and forced to sign a statement after being hosed with water and subjected to electrical shocks. Two days, later he was remanded in detention on suspicion of collecting money for the PKK (Kurdistan Workers’ Party) and disseminating propaganda against the indivisibility of the State. Uykur denied the allegations and was released the same day. On 15 February 1995, Uykur lodged a complaint with the Osmaniye Public Prosecutor alleging that he had been tortured during his detention and has been subjected to surveillance after his release. On 24 April 1999 the prosecutor decided not to press charges against a constable named by Uykur for lack of evidence. Uykur did not appeal the decision and subsequently appealed to the Commission. On 9 November 1999, the European Court of Human Rights found the application manifestly ill-founded and declared it inadmissible.
