Deed of release, James D'Arcy of Rock Hill, Oranmore, Co Galway, esq, [son and] administrator of the will of Martin D'Arcy [third son of Richard D'Arcy of New Forest, parish of Kilkerrin, barony of Tiaquin] and Dominick D'Arcy of Rock Hill, Oranmore, Co Galway, esq, executor of Isidore D' Arcy [second son of Richard D'Arcy of New Forest] (1), Richard D'Arcy of Well fort, Co Galway, esq [eldest son of Martin D'Arcy] (2), Richard D'Arcy of New Forest, Co Galway, esq, executor of his father James D'Arcy [eldest son], who was executor of his father Richard D'Arcy (3). Recites the will of Richard D'Arcy of New Forest, dated 12 May 1832, in which he left to his son Martin D'Arcy, the lands of Glenascahill and Moneymore, [parish of Oranmore], barony of Dunkellin and part of the Fidaun estate, [parish of Kilkerrin], barony of Tiaquin, which he was purchasing from the heirs of Edmond Kelly. Richard D' Arcy was also in the process of purchasing encumbrances on the Fidaun estate from the executors of Edward Hobson and from Richard Butler and James Barnes. There was litigation between family members over the administration of Richard D'Arcy's will. An amicable agreement was reached between James D'Arcy of Rockhill and Richard D'Arcy of New Forest in 1853. James D'Arcy by this deed agrees, in return for certain premises, to release Richard D'Arcy from all claims he might hold against him in particular under their grandfather's will, their grandparents' marriage settlement [Richard D'Arcy and Mary Blake], and in relation to a mortgage of £4,750 on the lands of Kentstown [parish and barony of Killian, Co Galway]. The deed includes references to a compromise reached with the heir at law of Edmond Kelly over the Fidaun estate in 1847, to the marriage settlement, dated 12 Sept 1827, of James D'Arcy and Elizabeth Cheevers and to the wills and deaths of various members of the D'Arcy family.
