DEED OF BARGAIN AND SALE

Parties:
1) Francis Drew, Ballaghanilly (County Limerick) and John Drew, Ballyduff (County Waterford)
2) Richard Croker, Nadrid (County Cork) and Richard Downing, Tubritt (County Tipperary) [bargainees]
3) Henry Wallis, Drishane (County Cork) and George Jackson, Glenbegg (County Waterford) [trustees].

Preamble: Arising from the will and testament of 3 March 1693 of Barry Drew (Ballyduff) about his inheritance in fee simple in Killmacdonnell, to be granted and released to Richard Croker and Richard Downing. Barry Drew gave to his sons Francis and John, and daughter Susanna, all of his estate (executors were John Nettles, Richard Downing, George Jackson, Henry Wallis, Boyle Andrews). Susanna died and disputes arose between the brothers, so that four of the executors eventually awarded on 5 November 1705 all of the Limerick estate to Francis Drew and heirs, paying £1,621-10 of debts, while the farm at Ballyduff and Shiane went to John Drew for the payment of £105 [rent arrears] and £250 of his share; John being hereby entitled to share a rent charge on all real estate. Both Drews now grant a bargain and sale to Richard Croker and Richard Downing [bargainees] of their possessions for one year.

Property: Killindonnell [Kildonnell], Clashnacoole, Clonbanniffe, Ballyghanilly, Ballyanliffe, [Ulay]more, Killcoleman; in the Barony of Connell, County Limerick.

Duration: [1 year]

Rent: £20 annually, to be paid to George Jackson and Henry Wallis (trustees of the rent charge) on All Saints and on Saints Philip and Jacob.

Use [of rent]: to Francis Drew, his heirs, then John Drew, his heirs. Francis has right to sell this inheritance (or fee simple) of the lands of Killcoleman. Both can lease any part of these lands; conditions if one or the other grants parts to a wife, and her contribution to paying off debt. (Enclosing typescript copy (5 pp), unknown agency.)
